Massive police violence against refugees in Kreuzberg

During a police operation on the night of 16. to the December 17, 2013, there were massive violations of the law on the part of the police. Public opinion has recently turned in favor of the refugees’ protest after Henkel’s eviction threats. That exactly at this time such a martial police action against the Gerhard Hauptmann School inhabited by refugees takes place is probably no coincidence, according to the press release of the refugees.

*Press statement on the massive violations of the law on the part of the police during the operation on the night of December 16-17, 2013.

Massive police violence against refugees in Kreuzberg. Protest movement of refugees to be criminalized. We demand a clarification and a rethinking of the police and the Interior Senate.

On Dec. 16, 2013, at approximately 10 p.m., an altercation occurred outside the school between several males. Serious injuries occurred and one person was taken away by ambulance.

The subsequent actions of the police show considerable disregard for applicable laws in several places.

A police contingent of about 150 officers, disproportionate to the search for a perpetrator, completely sealed off the school from 11 p.m. until about 3:30 a.m. the next morning.

The legal examination of the action of the police was prevented, lawyers and also politicians were kept out of sight, so that there could be no witnesses for the criminal proceeding of the police locally.

The SEK also entered the apartment building. Residents were arbitrarily criminalized. Everyone was handcuffed, personal data was collected and photos were unlawfully taken, on which a number had to be held up. People who protested against the unlawful measure were brutally mistreated. In the front building of the school, the social center, people were penned up in groups in order to take more photos under duress and to determine their personal data. Some of the refugees were asked for their cell phone numbers in this situation. People without papers were taken away. Among other things, unlawful charges were filed for so-called violations of the residence obligation.

These measures have nothing to do with police work to find a suspect, especially since the crime occurred off-site. Criminalizing all the residents of the house and creating charges for reasons not remotely related to the search for a possible perpetrator who may have taken refuge in the school is a scandal that proves the unwillingness of the emergency services on the ground to comply with applicable laws.

Public opinion has recently turned in favor of the refugees’ protest after Henkel’s eviction threats. That such a martial police action against the Gerhard Hauptmann School, which is inhabited by refugees, is taking place at exactly this time is probably no coincidence. Rather, political motivation shines through in this criminalizing and inhumane action of the Berlin police: The protest movement of the refugees is to be intimidated by demonstrations of power by the police. The blanket suspicion of the entire people who live in the school is clearly due to racist actions and thought patterns.

The unlawfully violent photos and ads must be immediately deleted and dropped, and those responsible for them must be held accountable.

Released came traumatized by the police cordon and with head and other injuries to the stunned neighborhood. One person is deaf in one ear after being attacked by a police officer. In their statement, the police speak of charges of
Resistance, assault and insult she created against neighbors who demanded a stop to police action in front of the police cordon. This does not correspond to the truth the announcements were made rather with the illegally created photos and arrests of uninvolved, which protested against the treatment.

The actions of the police are being investigated by lawyers.

We demand:

Destruction of all illegally created photos

Dropping all ads that have come about illegally

Formation of an independent commission of inquiry

Responsibility of the responsible before the rule of law

Investigation of the crimes committed by the police officers

*Declaration to the massive violaton of law from the site of the police during the police action on the 16th and 17th december 2013.

Massive police violence against refugees in kreuzberg. Protestmovement of refugees should be criminalist. We demand an investigation and a rethink from the police and the interior senate.

On the 16.12.2013 at 10 pm outside of the school there was a dispute between several man. There were serious injuries and one person was driven away by ambulance. The folowing acting of the police was in several matters against applicable laws.

A for the search of one person disproportionate police contingent of approximately 150 police officers closed from 11 pm to 03:30 am the next morning, the school completely.

The Legal review of the approach of the police was prevented. Lawyers and politicians were kept out of sight so that there was no witnesses to the criminals acting of the police.

Also the SEK broke into the house. There were arbitrarily criminalization of inhabitants. General to everyone was applied handcuffs, identity controll and unlawfully enforced photos on which a number had to be upheld. People who were abused were protesting against the illegal and brutal action. In the front of the school building the social center people were taken in groups to create additional photos identity controls. Some of the refugees were asked in this situation about their cell phone numbers.

People without documents were taken into costety. It was created, illegal charges because of so called violation of residency obligation.

These measures have nothing to do with the Police work after the search of a suspected person, especially since the act took place outside the school. To criminalize all inhabitants of the house and to create charges for reasons that are not related to the search for a possible offender who could have fled into the school, is a scandal. Which shows the unwillingness of the police forces in the place to behave acording to the law.

The public opinion was recently because of the threat for eviction from Henkel in favor with the protest of the refugees. That exactly at this time a so martial police action against the refugees from the Gerhard Hauptmann school takes place is most probably not random. Rather, this appears in the criminalizing and dehumanizing actions of the Berlin police with a political motivation: The protest movement of the refugees should get intimidated by a show of force to the police. The lump-sum suspicion of the total people living in the school is clearly leading back to racist actions and thought patterns.

The unlawfully under violation created photos and the charges have to be deleted immediately and the charges dropped and the responsibles have to be brought in front of justice.

Freedmen were traumatized and came with head and other injuries to the stunned neighborhood. A person is deaf in one ear after the attack by a policeman. In its declaration, the police speaks of charges on neughboors they made, like resistance, assault and insult. This is not true. Neighbors called for a stop of the proceedings of the police. The charges were rather made when they created the unlawful photos and arrests of uninvolved who protested against this treatment.

There will be investigations by lawyers on the police actions.

We demand:

For an independent investigation commission

Charge of the responsible in front of the rule of law

Destruction of all illegally created photos and charges

Investigation of the crimes committed by the police
